These Terms & Conditions ("Terms") govern your access to and use of the MySmartMedic Telemedicine software and application (the "App"), developed and operated by UNICCON Group ("we," "us," or "our").
1. Acceptance of Terms
By accessing or using the App, you agree to be bound by these Terms. If you do not agree to all of these Terms, you may not access or use the App.
2. Eligibility
You must be at least 18 years old and have the legal capacity to enter into contracts to use the App. The App is not intended for children under 13. We do not knowingly collect personal information from children under 13.
3. User Accounts
You will be required to create an account to access certain features of the App. You are responsible for maintaining the confidentiality of your account information and password and for restricting access to your device. You agree to accept responsibility for all activities that occur under your account or password.
4. Limitations of Service
We make no guarantees about the availability or uptime of the App. We may experience technical difficulties or require maintenance that could disrupt your access to the App.
5. Use of the App
You agree to use the App in a lawful and ethical manner and in accordance with these Terms. You will not:
- Use the App for any illegal or unauthorized purpose.
- Infringe on the intellectual property rights of others.
- Transmit any viruses or other harmful code through the App.
- Disrupt the use of the App by others.
- Collect or store personal information about other users without their consent.
6. Intellectual Property
The App and all content included therein, such as text, graphics, logos, images, and software, are the property of UNICCON Group or its licensors and are protected by copyright and other intellectual property laws. You may not modify, reproduce, distribute, or create derivative works of the App content without our express written permission.
7. Disclaimers
THE APPLICATION IS OFFERED "AS IS" AND WITHOUT ANY EXPLICIT OR IMPLICIT WARRANTY OF ANY KIND. ALL WARRANTIES ARE DISCLAIMED BY US, INCLUDING BUT NOT RESTRICTED TO THE FOLLOWING: MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT WARRANTIES. WE DO NOT PROMISE THAT THE APP WILL OPERATE UNINTERRUPTLY OR BE FREE FROM VIRUSES OR ERRORS. DO NOT USE THE SERVICES FOR EMERGENCY MEDICAL NEEDS. IF YOU EXPERIENCE A MEDICAL EMERGENCY, IMMEDIATELY CALL A HEALTHCARE PROFESSIONAL. THE CONTENT IS USED EXCLUSIVELY AT YOUR OWN RISK. GENERAL INFORMATION ABOUT MEDICAL CONDITIONS AND TREATMENTS IS CONTAINED ON THIS WEBSITE. YOU SHOULD USE THE INFORMATION AT YOUR DISCRETION. REGARDING THE SUITABILITY OF ANY DRUG OFFERED ON THE WEBSITE/MOBILE APP, YOU MUST ALWAYS CONSULT A REGISTERED MEDICAL PRACTITIONER, AS DEFINED UNDER THE DRUGS ACT ("REGISTERED MEDICAL PRACTITIONER"), IN LIGHT OF YOUR INDIVIDUAL NEEDS AND MEDICAL CONDITIONS. MOREOVER, YOU ACKNOWLEDGE AND AGREE THAT MySmartMedic WILL BEAR NO LIABILITY WHATSOEVER AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY CLAIM, DAMAGE, OR LIABILITY ARISING FROM ANY RELIANCE YOU MAY PLACE ON THE SAID CONTENT.

WE WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, DATA, OR GOODWILL.
9. Termination
We may terminate your access to the App at any time, with or without cause, and without notice. You may also terminate your account at any time.
10. Governing Law
These Terms will be governed by and construed in accordance with the laws of the State of Nigeria, without regard to its conflict of law provisions.
11. Dispute Resolution
Any dispute arising out of or relating to these Terms will be resolved by binding arbitration in accordance with the rules of the Nigerian Arbitration Association. The arbitration will be held in Abuja, Nigeria.
12. Entire Agreement
These Terms constitute the entire agreement between you and us regarding your use of the App.
13. Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
14. Changes to Terms
We may update these Terms from time to time. We will post any changes on this page and will notify you by email if the changes are material.
15. Third-Party Services
The App may integrate with third-party services, such as online appointment scheduling tools, lab results providers, or medication refill services. When you use these integrated services, you may be subject to the terms and conditions of those third-party providers. We encourage you to review the privacy policies and terms of use of any third-party services you access through the App.
We may share your information with third-party service providers to the extent necessary to provide the services offered through the App. These service providers are contractually obligated to keep your information confidential and secure.
We will retain your information for as long as your account is active or as needed to provide you with the services offered through the App. We may also retain your information for a longer period of time if required by law or to comply with regulatory requirements.

You may submit feedback, comments, and suggestions to us regarding the App ("Feedback"). You agree that we may use such Feedback for any purpose, without any obligation to you.
17. Indemnification
You agree to indemnify and hold us harmless from any claims, losses, damages, liabilities, including attorney's fees, arising out of or relating to your use of the App or your violation of these Terms.

By using the App, you agree to receive communications from us electronically, such as email notices and push notifications. You can opt out of receiving certain promotional emails by following the unsubscribe instructions in those emails.
19. Force Majeure
We will not be liable for any delay or failure to perform our obligations under these Terms due to causes beyond our reasonable control, such as acts of God, natural disasters, war, terrorism, or network outages.
20. Assignment
We may assign our rights and obligations under these Terms to another company without your consent. You may not assign your rights and obligations under these Terms without our prior written consent.
21. Waiver
Our failure to enforce any provision of these Terms will not be construed as a waiver of such provision or any other provision of these Terms.
